The Law requires that a victim give consent to an offer of help before a trained rescuer renders assistance. The Law assumes that an unconscious person would give permission. If victim is conscious, the rescuer must ask for consent before rendering help and consent is implied if the victim is unconscious, badly injured as to be life-threatening or a person so ill that they cannot respond. A rescuer should make a reasonable attempt to receive permission from a parent or guardian if the victim is a minor or who is mentally or emotionally disturbed. If a parent or guardian are not available, the rescuer may give aid without consent.

Generally State "Good Samaritan" laws provide rescuers with legal protection as long as the rescuer acts in "good faith" and are not acting with gross negligence or willful misconduct. The scope of protection concerning these laws vary from state to state and the rescuer should be familiar with the specifics of their own state's law.
